Many cell phone owners are unaware that anyone can buy a franchise under any cell phone carrier, increase prices, sell merchandise that was refurbished as new, and have a no refund policy that omits corporate responsibility. This is exactly what the store in Phoenixville is doing to many uneducated consumers.

On Tuesday, I went to the store to replace a broken phone on our family plan of 4. The phone is insured, but was told the $130 deductible was pointless since the phone lost that value the day after I bought it. I found the phone I wanted. Cost: $212.00. I questioned if it was new and about the packaging, as it was a post office box and not the manufacturers. Kyle Parker, manager and claimed owner, stated it was new. I brought it home, went to charge it, it wasn't charging. I tried different mico USB adapters and outlets. I took it back 3 hours later, received an exchange from the reluctant manager. Kyle told me the charger was 'special' and made especially for that phone. But yet, he tried to charger it from an universal micro USB from his merchandise and it still didn't work. I brought home the new-new phone and charged it over night. I woke up to an almost dead phone. I took it back the next day. Kyle denied my return and pointed to the receipt copy that clearly states under #2 of 10 no refund policy,"no returns or exchanges on outright phone sales or early upgrades". Kyle told me to call T-Mobile for a replacement.

So, I called T-Mobile, who had no record of my purchase! They asked where I bought the phone. I said,"Where your website shows the closest location, 251 Schuylkill Rd, Phoenixville." T-Mobile corporate directed me to their corporate store in Exton Mall. I was to go there, have the manager call down to the Phoenixville store to tell them to give me a full refund due to 'buyer's remorse'. I did this on Saturday. Kyle accepted the request over the phone but changed his tune when I came in 30 minutes later.

There's only one option at this point and that is to wait out my contract after 7 years of being a loyal customer, change cell phone carriers, and find where their corporate store location is for future shopping. Signing my credit card receipt with the no refund policy omits the store from responsibility, corporate has no responsibility, and having to pay for either an early contract termination fee @ $200/phone or just one phone with 9 months left on our contract doesn't make sense.

Please be aware cell phone shoppers! My bank statement has Be In-Touch wireless as the merchant, the email address for Kyle is Kyle@presidentialwireless.com, and T-Mobile neon sign hangs on the front of the building. This store is a scam and can legally get away with it!
