Cop Visits One Apartment, Issues Drug Charge in Another, Police Say

An East Pikeland Police officer says he spied a glass pipe through an open window while on an unrelated visit.

A 26-year-old Phoenixville man was charged with possession of drug paraphernalia late last month after an East Pikeland Police officer, while making a visit to an apartment adjoining his, spotted a glass pipe through his open window, the department is reporting.

According to court documents, on Feb. 26 at 5:20 p.m., an officer stopped by an apartment on the 500 block of Deer Run Lane to investigate a separate incident. While the officer was on the porch waiting to be admitted to the residence, he spotted a glass marijuana pipe sitting in “plain view” in the defendant’s kitchen, police say.

The officer seized the pipe and discovered that it had a black residue inside, consistent with burned marijuana resin. (Police say subsequent lab testing confirmed the residue was marijuana.)

The defendant admitted the pipe was his, according to police and was charged with possession of drug paraphernalia.

Ridiculous!!! I hope this officer is happy arresting another non-violent harmless dude over a friggin pipe. Pot, Alcohol, Cigarettes--either all should be legal or all should be illegal. Alcohol ruins families, bodies, etc. Cigarettes kill. What damage does pot do? I am in my 60's and although I don't indulge in pot anymore I feel it should be as accesible as alcohol and cigarettes.

Really!! I'm sure a pro bono law student can beat this charge . and can somebody reel in the east pikeland police they have gone drunk with power every week in here they look like the SS and trample the rights of people

It's weed , it's legalized in some states so who cares ? The prisons have overcrowded as it is leave the spots for real criminals and not the ones who have marijuana . I don't smoke weed but everyone has once in their lifetimes even police officers

This is exactly why most people hate suburban cops. These cowards actually get off on messing with people. If they had any guts, they would be in Philly, Chester, Coatesville, Upper Darby, etc....where the criminals actually shoot back instead of harrassing dudes with a bong in their house or some soccer mom or guy trying to go to and from work for BS traffic stops. This kid should push the case to West Chester where I bet it will be thrown out. The "plain view" provision doesn't really apply here because the guy wasn't actively smoking from the bong. This cop should be aSShamed to call himself a man but sadly I'll bet he is proud and bragging to his other cop buddies about messing up some dude's life who wasn't bothering anyone!

Gambling is illegal--yet every social club and catholic church in the Phoenixville area has it. Prostitution is illegal yet who are those women walking around bridge street at night? Is it a nightly Wal-mart fashion show? If the PD looks the other way on these issues--why would they waste their time on a little weed? Where is the outrage from the younger people? When this kind of Police behavior occured in the 60's my generation immediately organized and protested (legally). I sure hope this officer got a gold star on his notebook from Sarge.

It will thrown out, he did not have a search warrant! And you're right, these cops could not work in Philly, Chester, Coatesville, Upper Darby, The young man is at home, it's not like he's smoking a joint at the police station although half the cops would join him. Lighten up damn it's not heroin!

Yes , pot is legal for recreational use on some states wich is bull s*** because its still a federal crime . So call the cop a pig.and a scum bag for what ? Because the guy was doing something illegal and the cop was doing his job ? I bet if there was drug activity going on in front of your house you wouldn't be able to dial the phone quick enough asking them to come arrest the people ! High school is over . Hey meg , whose beating a bible ? I'm 54 and been smoking since I was 13 I was a pretty heavy alcoholic for 15.yrs and haven't touched a drop in 8 yrs without a spot on my liver . I'm not beating a bible , I just feel lucky . And by the way , I don't have kids but that's neither.here mor there the point I'm trying to get across is why call the cop a pig and a scum bag.for doing his job . Males no sense .

seeing a pipe thru an adjacent window of your existing call and that leading to an arrest without the benefit of a warrant and then it only leading to paraphernalia charge (which wont stand up anyway) doesnt sound like a police officer who is to protect and serve. it sounds like a zealot out to stick it to everyone he can and that is what even police depts worry about. the public's view of the police has changed over the and for good reason

Not enough information in the article to try the case, but I would think that if the table is visible through a window then you don't really have a reasonable expectation of privacy, and the police officer would have probable cause to search the residence without a warrant. If he knocked on the door, and asked if he could look around and the individual agreed, then the police office would not need a warrant.

Gambling is NOT illegal. Any organization that can meet the requirements, applies for and is granted a small games of chance license is subject to state regulation. Many organizations in Phoenixville hold these licenses. Get your facts straight.

Mary Spin--get your head out of the sand. When I referenced gambling is illegal I was refering to the big stake card games and the sports betting with bookies that go on in the "clubs" not fundraising games of chance.
