If he was passed out in his car, not driving on the road, how is that a DUI? If anything this poor SOB showed enough sense to get off the road instead of driving drunk but these cops are so eager to get a DUI , they charge a guy who wasn't even driving. Tresspassing, maybe but DUI when you aren't driving? Please!

I agree that he showed good sense by pulling over. But, did you consider how he got to that pull-over place? He didn't pull or push his car there. So, he must have been DRIVING under the influence, I guess.

Unless the car was running, a good lawyer beats this case in court. The guy could say he met some people at that lot, went out drinking with them, got dropped off there and passed out. Best they can PROVE is public drunkenness or trespassing and even that is not a slam dunk. If he is too poor to get a good laywer, he'll get screwed and end up being railroaded into a guilty plea and about 3K in fines. American justice at it's finest.

I think you can get charged if your keys are in the ignition?
