Phoenixville Man Charged for Drugs Found in Apartment

A felony charge of possession with intent to deliver and other drug-related charges were filed in district court.

A search warrant led to an arrest Tuesday after police allegedly found drugs and paraphernalia in a downtown apartment. 

Brendan Herbetko, 23, of Phoenixville, was arraigned in front of District Judge Jeffrey Valocchi, who set bail at $60,000 cash. According to a criminal complaint, Herbetko is the lessee of an apartment where police allegedly found cocaine and marijuana along with paraphernalia.

On Feb. 28 at 3:20 p.m., police executed a search warrant for an apartment in the first block of Gay Street, according to the criminal complaint filed by Det. Sgt. Glenn Eckman of Phoenixville Police Department. Eckman, who works as a Special Detective with the Chester County Detectives as part of the county’s Municipal Drug Task Force, wrote that police found evidence that Herbetko was dealing drugs.

Inside the apartment, police allegedly found the following, according to the criminal complaint:

  • Seven small baggies of suspected cocaine in individual packages;
  • More than 200 unused small plastic bags;
  • A digital scale;
  • A small bag of suspected marijuana;
  • Several small plastic jars; and
  • U.S. currency, along with documents indicating that Herbetko lived at the address as the sole occupant.

Herbetko was taken into custody and was arraigned Tuesday evening. In addition to felony possession with intent to deliver, he’s charged with two counts of drug possession, drug paraphernalia possession and intent to deliver drug paraphernalia.

A preliminary hearing is scheduled for March 8 in front of District Judge Theodore Michaels. Herbetko remains in prison, unable to post the $60,000 bond.
